What documents do you need to take on a property for sale in Portugal?

Taking on a property starts with the paperwork, not with the photographs. Two documents decide almost everything that follows: the caderneta predial, which carries the VPT, and the land registry certificate, which shows who owns the property and what is charged on it.

Short answer

  1. Start with the caderneta predial: it carries the VPT, and IMT is charged on the higher of the sale value and the VPT - artigo 12.º CIMT.
  2. Get the land registry certificate as well: it shows the owner and any charges, such as a mortgage that has to be discharged.
  3. The energy certificate is issued by a qualified expert and its energy class is what appears in the listing, so order it before publishing.
  4. A property file that is complete before the listing goes live is what keeps the sale from stalling between the promissory contract and the deed.

The caderneta predial: the document that sets the buyer's tax

IMT is charged on the value of the contract or on the VPT, whichever is higher - artigo 12.º CIMT. That single rule turns the caderneta predial into the most consequential document in the file. If a property is agreed at 200,000 euro but its VPT is 230,000 euro, the buyer pays IMT on 230,000, and an estimate that used the agreed price is wrong by the difference. Reading the VPT off the caderneta before writing the listing is the cheapest way to avoid an unpleasant conversation at the promissory contract.

The file to assemble before publishing

The list below is agency practice: it is the set of papers the notary, the buyer and the buyer's bank ask for in almost every transaction. Confirm the exact requirements for your case with the notary, the Casa Pronta desk or the land registry handling the deed.

  • Caderneta predial urbana, for the VPT, the description of the property and its tax identification.
  • Certidão permanente do registo predial, for the ownership and for any charges - a mortgage, a seizure, a right of preference registered against the property.
  • Certificado energético, issued by a qualified expert, whose energy class goes into the listing.
  • Licença de utilização for the property, and the ficha técnica da habitação where the property has one.
  • For a flat in a condominium: the condominium administration's details and confirmation that the charges are up to date.
  • Where a mortgage is registered: the lender's statement of the outstanding balance and what is needed to discharge it, requested early rather than in the week of the deed.
  • The identification documents of all the owners, including anyone who has to consent to the sale.

What the file changes for the buyer

A complete file is also a more accurate cost estimate. With the VPT in hand you can tell the buyer the IMT band that applies; with the deed and registration handled at a Casa Pronta desk, the reference figures are 375 euro when buying with own funds and 750 euro with credit, which covers the purchase and the mortgage together with the corresponding registrations. Stamp duty is added on top in every case: 0.8% on the acquisition, and 0.6% on the capital financed for loans of five years or more.

Three mistakes that delay a deed

  • Estimating IMT from the asking price without looking at the VPT on the caderneta predial.
  • Leaving the discharge of an existing mortgage until the week of the deed, when the lender's paperwork takes longer than that.
  • Publishing the listing before the energy certificate exists, so the energy class has to be added later and the advertisement is corrected in public.

How 4property helps your agency

In 4property every property card carries a document checklist, so a consultant sees at a glance what is still missing before the listing goes to the portals. The VPT and the caderneta predial are stored on the card itself, which means the listing, the buyer's cost estimate and the mediation contract all draw on the same values rather than on three different versions in three inboxes. Viewings and follow-ups are recorded per property and per client, so the history of the sale is in one place when the deed is being prepared.
