What documents do you need to advertise and sell a property in Hungary?

The first document is the tulajdoni lap, not the photographs. It shows who may sign, what is charged on the property, and it is also the document the lawyer checks before drafting the contract.

Short answer

  1. Start with the tulajdoni lap: a certified copy supplied as an electronic document costs 4,800 forint - 1/2024. (I. 30.) KTM r. 20. § (2).
  2. In Hungary the sale contract is drafted and countersigned by a lawyer, not a notary. The lawyer checks identities and the content of the tulajdoni lap and files the registration application with the land registry.
  3. A mortgage on the tulajdoni lap does not reduce the buyer's duty: the base is the market value undiminished by encumbrances.
  4. Registering ownership costs 10,600 forint per property affected, and registering a mortgage a further 20,000 forint - 1/2024. (I. 30.) KTM r. 7. § (1) and (2).

Read the tulajdoni lap before writing the advertisement

The tulajdoni lap names the owners, describes the property and records the rights and encumbrances registered against it. Reading it before publishing prevents the two worst outcomes: advertising details that the register contradicts, and discovering a co-owner or a registered right a week before the signing. It also determines what has to be arranged before the deal can close - an existing mortgage has to be cleared, and the lender's paperwork takes time.

What the register decides about the costs

  • Certified copy of the tulajdoni lap, supplied electronically: 4,800 forint - 1/2024. (I. 30.) KTM r. 20. § (2).
  • Registration of ownership: 10,600 forint per property affected - 7. § (1).
  • Registration of a mortgage where the buyer borrows: a further 20,000 forint per property affected - 7. § (2).
  • The lawyer's fee is not in this list, because there is no statutory tariff: under Üttv. 28. § the fee is a matter of free agreement. Ask for a written quotation and clarify whether it covers VAT, obtaining the tulajdoni lap, the land registry filing and any extra deeds required by the lender.
  • The bank's own costs - valuation, disbursement fee, notarial deed - come on top, differ from bank to bank, and should be requested separately alongside the total cost indicator of the loan offer.

The rest of the file to assemble before publishing

The list below is agency practice, not a statutory catalogue: it is what the acting lawyer and the buyer's bank ask for in almost every transaction. Confirm the exact scope with the lawyer handling the deal.

  • The document under which the seller acquired the property - the earlier sale contract, a deed of gift, or the document establishing inheritance.
  • The identification documents of every owner, including anyone whose consent the sale requires.
  • An energetikai tanúsítvány. This is routinely requested in sale transactions, and issuing it takes days, so order it before the advertisement goes live rather than after a buyer appears.
  • For a flat in a condominium: the founding deed and the organisational rules, plus a statement from the manager that the common charges are settled.
  • Where a mortgage is registered: the lender's statement of the outstanding balance and its consent to deletion, requested early rather than in the week of signing.
  • Where the buyer intends to rely on a cserepótló purchase: proof of the market value of the dwelling sold, since the duty base is the difference between the two values.

Check the agent as well

Estate mediation as a business remains a notifiable activity under 1993. évi LXXVIII. tv. 64/A. §. The register is kept by the notary of the county-seat municipality, in Budapest by the Chief Notary of the Capital, and it can be searched publicly and free of charge on the OKNYIR site. Checking it takes a minute and belongs in the same routine as pulling the tulajdoni lap.

How 4property helps the agency

In 4property each property record carries a document checklist, so the agent sees at a glance what is still missing before the listing reaches the portals. The property details, the ownership situation and the documents live on the same record, which means the advertisement, the buyer's cost estimate and the mediation contract all draw on the same figures. Viewings and follow-ups are logged per property and per client, so when the lawyer starts preparing the contract the history of the sale is in one place instead of in three inboxes.
